Policy Regarding Digital Millennium Copyright Act

Greetings to all who visit the website known as the ‘Site’. We value the creative rights of individuals as we expect others to value our rights as well. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17 of the United States Code, Section 512(c), a copyright owner or their representative can send a notice of copyright infringement to our designated DMCA Agent listed below. As an internet service provider, we are protected by the “safe harbor” provisions of the DMCA.

Information Required for Notice of Infringement – Claim

  1. A physical or electronic signature of the copyright owner or their authorized representative.
  2. Identification of the copyrighted work that has been infringed upon.
  3. Identification of the infringing material to be removed and information to help us locate it.
  4. Contact information of the complaining party including name, address, email, phone number, and fax number.
  5. A statement from the complaining party affirming that the use of the material is unauthorized.
  6. A declaration that the information provided is accurate and the complaining party is authorized by the copyright owner.

Section 17 USC ยง512(f) imposes penalties for the misrepresentation of information in a notification of infringement. All takedown notices should be sent via our Contact page, preferably through email for a quick response.

It should be noted that we may share the identity and information in any copyright infringement claim with the alleged infringer. By submitting a claim, you acknowledge that your information may be disclosed to the alleged infringer.

Counter Notification Process for Restoration of Material

If you have received a takedown notice due to a copyright infringement claim, you can provide a counter notification to have the material reinstated. This notification must be in writing and contain specific elements outlined in 17 USC Section 512(g)(3).

  1. Your physical or electronic signature.
  2. Description of the taken-down material and its original location.
  3. Statement under penalty of perjury that the material was removed by mistake or misidentification.
  4. Your contact details and consent to jurisdiction for legal proceedings.

Policy on Repeat Infringers

We have a strict policy against copyright infringement. Under the DMCA, we keep a record of notices from copyright holders to identify repeat infringers. Accounts of repeat infringers will be terminated.
